Dan Rosenthal, a partner with Petro Cohen P.C., recently had a successful resolution on behalf of one of our workers’ compensation clients which resulted in an Order Approving Settlement for $193,000. Our client had been employed by ACME Stores for roughly 30 thirty years when tripped on a “spider rack” which was used to display merchandise. As a result of his fall, our client sustained injuries to his cervical spine, lumbar spine, and both legs. The Workers’ Compensation carrier aggressively defended the claim. What became challenging in this case was the fact that our client had preexisting complaints with respect to the body parts injured from this fall. Nevertheless, Petro Cohen vigorously prosecuted the claim, ultimately succeeding in an award of compensation to our client for his injuries.
