We are pleased to report another victory in the Workers’ Compensation Court, once again proving “wear and tear” is real.

Our client was a hardworking casino soft-count technician who had worked for casinos for more than 25 years. He had a previous neck surgery a number of years ago but was able to return to work. However, he developed a gradual worsening of his neck pain on the job to the point where he needed another neck surgery.

The casino denied his claim and refused to offer any type of settlement. We tried his case to a conclusion. The Judge found completely in his favor on the basis that our client was credible, loyal, hardworking, and most importantly, that his repetitive job duties aggravated his condition to the point where further surgery became necessary.

The Judge found him to be significantly disabled entitling him to a substantial workers’ compensation award.

This case is another example of how significant “wear and tear” claims can be when properly and fully pursued under the New Jersey Workers’ Compensation Law.
