When it comes to legal representation, Choose Carefully. In litigation, you don’t get a second chance.
When you are injured are work, the first and most important thing that you must do is advise your employer of the accident as quickly as possible, even if you are unsure whether the injury is serious. By law, you are required to report your workplace injury within 90 days of the occurrence.
Claimants are paid benefits based on the severity and nature of the work-related medical condition, not on who is to blame for the accident. You are covered by workers’ compensation starting the first day you begin working and employers (regardless of size) must have workers’ compensation coverage.
At first glance, filing a workers’ compensation claim seems relatively easy. We often are asked if it is truly necessary to hire legal representation for a workers’ comp claim. After all, certainly your employer and their workers’ compensation insurance company will provide you with the medical treatment and monetary compensation that you rightfully deserve. Unfortunately, that is not always the case.
As a resident of Monmouth County, NJ, there are three types of benefits to which you are entitled.
Temporary Disability Benefits – are tax-free weekly benefits representing 70% of your gross weekly wage, payable up to 400 weeks. These benefits are payable while you are temporarily unable to work because of a work-related medical condition and under active medical treatment.
Medical Treatment – all reasonable and necessary medical charges to treat your work-related medical condition are payable by the workers’ compensation insurance carrier. The carrier has the initial right to authorize specific physicians who are competent to treat your condition. If a problem arises concerning the medical treatment you require, you have the right to make an application to a Judge of Workers’ Compensation. With our assistance, we can work with you and the Judge for a determination as to what, if any, additional compensable medical treatment you require.
Permanent Partial Disability – is additional compensation which is payable to you, if after your completion of compensable medical treatment, you have a measurable loss of physical function proven by “demonstrable objective medical evidence.” This benefit can be payable to you even if you are able to return to work and have made an excellent recovery.
To ensure you receive all of the benefits you truly deserve, it is best to have a skilled and experienced workers’ compensation attorney by your side.
By law, attorneys cannot charge you a retainer fee. Legal fees are only payable once a claim is concluded and a Judge of Compensation orders the workers’ compensation insurance carrier to pay us the fee.

You may qualify for benefits if you are seriously and permanently disabled due to a medical or psychiatric condition, whether it is the result of a disease, accident, or congenital condition. You can apply for Social Security Disability at any time as long as the medical evidence shows that you will be unable to perform gainful work for 12 consecutive months or that your condition may result in death. Petro Cohen Petro Matarazzo can help you apply for benefits, request the reconsideration of a denial, or appeal a denial and ask for a hearing before the Social Security administrative law judge.
